Nerfpalooza
Terms, waivers, and liability
For the purposes of this agreement, “NerfPalooza,” “Nerf Battle Palooza,” and any similar name or variation referring to NerfPalooza shall be understood to mean the same entity and may be used interchangeably.

**Deposits and Reservations Policy**
All deposits are final and non-refundable after hours. It's important to understand that merely discussing your event or receiving a quote does not secure your booking; a deposit and a confirmation email are essential. If you place a deposit but do not receive a confirmation within 24 hours, contact us immediately verify your booking. Our reservations are managed through a real-time availability calendar on our website, and time slots are filled on a first-come, first-served basis. We do not hold slots without a, so act promptly to secure your desired time.
WEATHER:
Weather conditions can influence our activities, and we prioritize the safety of all participants and equipment. The decision to continue or halt an event rests with us. If an event interrupted due to weather, we will apply a prorated rate. Should you need to postpone, your deposit can be transferred to another available date. Simply contact us to rebook; however, please note that if you choose to cancel instead, your deposit will be forfeited.

CHANGES TO RESERVATIONS:
All changes to existing reservations must be communicated in writing via email toNerfpalooza. We do not accept changes made through text phone, or in person, and we will be responsible for those requests. To avoid any issues, please confirm any changes you want make to your event after a reservation been made. ​

ADDITIONAL FEES/PLAYERS/TIME:
Locations that are more than 25 miles in one direction from our starting location exceeding miles from our starting point will incur a mileage fee of $1 per mile, applied to your total event. Online bookings are subject to a 6% fee, which is outside our control and does not contribute to your event total or deposit. Each package includes a specified of players, and additional players can be added at $20 each, or $40 for archery tag. Payment for the full amount including any additional charges, is required at the initial of event. (If a larger amount of players is needed, additional fees/staff may be required). Additional time may be added on at a rate to be determined by us should scheduling allow. It is up to our discretion to allow or deny any additional players or time above our agreed upon event.

DEFINITION OF PLAYERS/PARTICIPANTS:
Any individual—of any age—who handles NerfPalooza equipment or participates in our activities is considered a “participant” or “player” and must follow all NerfPalooza safety rules and procedures.
NerfPalooza takes great pride in our structured safety protocols and the clear instructions we provide to every player before gameplay begins.
NerfPalooza is not responsible for any participant’s failure to follow directions, any injuries resulting from negligence or accidental behavior, or any damage caused to the property or venue hosting the event.

PHOTOS/VIDEOS:
NerfPalooza reserves the right to capture photos and videos during all events and to use this content on our website and social media platforms, unless the client provides written notice requesting otherwise.

WAIVERS/SAFETY:
All participants in your event who wish to play or engage in any NerfPalooza activities must sign the required liability waiver (insert hyperlink here).
Safety equipment must be worn at all times whenever a player is holding one of our blasters—whether or not it is loaded or powered on—or whenever a game or activity is underway. Additionally, anyone under the age of 18 who is within six (6) feet of the battlefield during active play must wear safety gear or relocate outside the area to prevent potential injuries.
NerfPalooza welcomes participants of all ages, from 5 and above! All players under the age of 18 are required to wear NerfPalooza-issued protective gear in order to participate. Players aged 18 and older may choose to opt out of protective gear at their own risk. If an adult participant declines our protective equipment, NerfPalooza is not responsible for any injuries that may occur as a result of refusing protective gear.

LIABILITY:
By placing a deposit and hiring NerfPalooza to provide services at your event, you acknowledge and agree that Nerfpalooza Events, Nerf Battle Palooza, and all of their agents, officers, employees, and volunteers shall not be held liable or responsible for any injuries, property damage, or any other losses or damages—monetary or otherwise—incurred by any person or property at your event. You further agree that you will not pursue, initiate, or support any form of litigation against Nerfpalooza Events, Nerf Battle Palooza, or any of their representatives for any reason.
If any guest (including individuals who attend your event but do not directly participate in NerfPalooza activities), participant, or player intentionally or accidentally damages our equipment, you, as the event host, assume full financial responsibility for the replacement cost of the damaged item. Additional penalty fees may apply depending on the specific item and the time required to replace it.

PAYMENTS AND PENALTIES:
By booking with NerfPalooza, you authorize the card on file to be charged for the remaining balance of your event on the day the event takes place. If you prefer to pay in cash or use a different card than the one used for your deposit, please notify us in advance and we will gladly accommodate your request.
If the card on file declines or does not authorize the remaining balance, we will make reasonable attempts to contact you within 48 hours to complete the payment. If we are unable to reach you, or if the final payment is not received within three (3) days following your event, a penalty fee of $25 per day will be applied until the balance is paid in full.
Failure to complete payment for services rendered may result in legal action. By proceeding with your booking, you acknowledge and agree to these terms, including all associated penalties and the potential for legal proceedings.
